Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the websites, marketing materials, and related online properties operated by Daytonix LLC, doing business as ProtechBand (“ProtechBand,” “we,” “us,” or “our”), including protechband.com and any successor marketing sites. Use of the ProtechBand product platform (including dashboard.protechband.com and wearable devices) may also be governed by a separate customer agreement, order form, or master services agreement (“Customer Agreement”). If there is a conflict between these Terms and a Customer Agreement, the Customer Agreement controls for the paid services it covers.
By accessing our marketing site or submitting an inquiry, you agree to these Terms and our Privacy Policy.

2. Informational nature of the marketing site
Content on this site is for general informational purposes about our enterprise wearable panic-button and safety platform. It does not constitute a binding offer, medical advice, legal advice, or a guarantee of specific safety outcomes. Product features, availability, and pricing may change. Demo and trial availability are subject to qualification and our confirmation.
3. Accounts & client login
Access to the client dashboard at dashboard.protechband.com requires credentials issued under a Customer Agreement or authorized trial. You are responsible for safeguarding credentials assigned to you and for activity under your account. Notify us promptly of unauthorized access.
4. Acceptable use
You agree not to:
- Use the site or services for unlawful, harmful, or fraudulent purposes
- Attempt to gain unauthorized access to systems, devices, or data
- Interfere with or disrupt the site, dashboard, or device networks
- Scrape, reverse engineer, or misuse our intellectual property except as allowed by law
- Submit false or misleading contact information
- Use SMS or messaging features in violation of applicable telecom or consumer-protection laws
5. SMS / text messaging terms
If you opt in to receive SMS/text messages from ProtechBand:
- You confirm you are the owner or customary user of the mobile number provided and are authorized to consent to receive texts at that number.
- Consent to receive marketing texts is not a condition of purchasing goods or services.
- Message frequency varies. Message and data rates may apply.
- Reply STOP to opt out; reply HELP for help. You may also contact Support@ProtechBand.com or +1 (913) 274-9960.
- We do not sell or share your mobile number or SMS opt-in with third parties or affiliates for their own marketing.
- Supported carriers and delivery are not guaranteed; carriers are not liable for delayed or undelivered messages.

6. Intellectual property
All trademarks, logos (including the ProtechBand name and marks), text, graphics, and software on this site are owned by Daytonix LLC or its licensors. You may not copy, modify, or distribute site content without prior written permission, except for reasonable personal or internal evaluation use of publicly available marketing materials.
7. Third-party services & links
The site may link to third-party websites or services. We are not responsible for their content, terms, or privacy practices. Your use of third-party services is at your own risk and subject to their terms.
8. Disclaimers
THE MARKETING SITE AND ANY FREE INFORMATIONAL MATERIALS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ProtechBand safety products are tools to assist organizational response programs; they do not replace trained security, clinical judgment, emergency services, or regulatory compliance obligations of the customer organization.
Warranties for paid hardware, software, and services are solely as stated in the applicable Customer Agreement or product documentation.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAYTONIX LLC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE MARKETING SITE OR RELIANCE ON ITS CONTENT. OUR TOTAL LIABILITY ARISING OUT OF THESE TERMS RELATED TO THE MARKETING SITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted.
Liability for paid products and services is governed by the Customer Agreement.
10. Indemnity
You agree to defend and indemnify Daytonix LLC and its personnel from claims arising out of your misuse of the site, your violation of these Terms, or your violation of applicable law, except to the extent caused by our willful misconduct.
11. Privacy
Our collection and use of personal information is described in our Privacy Policy, which is incorporated by reference.
12. Governing law
These Terms are governed by the laws of the State of Kansas, USA, without regard to conflict-of-law principles, except where a Customer Agreement specifies otherwise. Exclusive venue for disputes arising from the marketing site shall be the state or federal courts located in Kansas, unless mandatory law requires otherwise.
13. Changes
We may update these Terms by posting a revised version with an updated effective date. Continued use of the marketing site after changes constitutes acceptance of the revised Terms. Material changes to SMS programs will be communicated as required by law or carrier rules.
